Lettere Americane 7: Aborto, un caso storico davanti alla Corte Suprema degli Stati Uniti Tra fuga di notizie e questioni di competenze istituzionali

La Corte Suprema sta esaminando una causa intentata per estromettere il governo federale degli Stati Uniti dal settore dell'aborto. "È infatti illegale che la Corte crei leggi, si dovrebbe limitare a giudicare o ad applicare le leggi create dal legislatore eletto"

Caro Direttore,

Proprio mentre stavo terminando la mia ultima lettera sul Cinco de Mayo, all’inizio di maggio 2022, si è verificata una fuga illegale di notizie presso la Corte Suprema degli Stati Uniti (SCOTUS).

È interessante notare che questo fatto non è stato trattato da nessuno dei vostri principali organi di informazione italiani, il che dimostra un’attenzione parziale alle  notizie sia in Europa che in Nord America.  Al momento della stesura di questa lettera non si conoscono ancora molti degli ultimi fatti relativi alla fuga di notizie, ma passiamo in rassegna ciò che è attualmente noto per aggiornarvi sulla situazione.

Il sistema legale degli Stati Uniti è in fase di revisione di un caso storico sull’aborto chiamato Roe v. Wade. Questo caso è il cavallo di battaglia del Partito Democratico e dei liberali di tutto il mondo.  Il fatto è che Roe è un caso discutibile, ma è diventato legge nel 1973 !

Lo scandalo 

L’attività illegale è stata la fuga di notizie da parte di un dipendente su una bozza di parere pre-decisionale del giudice Samuel Alito. Ai dipendenti della Corte Suprema vengono affidati alcuni dei materiali legali più importanti degli Stati Uniti.  Hanno giurato di proteggere le informazioni loro affidate, in particolare le bozze di parere che non sono ancora state diffuse o discusse dagli altri giudici. Le bozze di parere vengono fatte circolare, poi discusse e quindi votate.  I giudici della SCOTUS scrivono poi i loro pareri, che diventano di dominio pubblico e la decisione viene resa pubblica. Questo processo è stato ostacolato dalla fuga di notizie.

Ci sono circa 37 cancellieri e 30 collaboratori, o potrebbe essere coinvolto un giudice. Poiché sono tutti avvocati, la pena potrebbe essere il licenziamento, la sanzione e la radiazione dall’albo degli avvocati (tutte ipotesi molto probabili).

Nel caso in cui sia stato un giudice a fare la soffiata, è probabile che venga messo sotto impeachment dalla Camera e confermato dal Senato, perdendo così il suo incarico a vita.

La fuga di notizie è avvenuta perché qualcuno non era d’accordo con la bozza di parere del giudice Alito (che è il secondo giudice italo-americano della SCOTUS nella storia della Corte) sulla Roe e ha tentato di far cambiare alla SCOTUS le sue bozze di parere.

A seguito della fuga di notizie, i manifestanti di estrema sinistra hanno circondato la Corte Suprema e le abitazioni private dei giudici, molti dei quali hanno figli piccoli.  L’intento della protesta era quello di influenzare e cambiare l’opinione dei giudici, il che è contrario alla legge statunitense. Il sito web della Cornell Law School parla specificamente del 18 U.S. Code § 1507 – Picketing or parading (picchettaggio o sfilata).

“Chiunque, con l’intento di interferire, ostacolare o impedire l’amministrazione della giustizia, o con l’intento di influenzare un giudice, un giurato, un testimone o un ufficiale giudiziario nell’adempimento del proprio dovere, faccia picchetti o sfili all’interno o nelle vicinanze di un edificio che ospita un tribunale degli Stati Uniti, o all’interno o in prossimità di un edificio o di una residenza occupata o utilizzata da tale giudice, giurato, testimone o funzionario del tribunale, o con tale intento utilizza un camion sonoro o un dispositivo simile o ricorre a qualsiasi altra dimostrazione all’interno o in prossimità di tale edificio o residenza, sarà multato ai sensi del presente titolo o imprigionato per non più di un anno, o entrambi.  Nessuna disposizione della presente sezione interferisce o impedisce l’esercizio da parte di qualsiasi corte degli Stati Uniti del potere di punire per oltraggio alla corte”.

Ora posso capire le proteste alla Corte Suprema, anche se sono contro la legge. Ma è chiaro che protestare a casa di qualcuno è contro la legge ed è moralmente riprovevole minacciare la famiglia di qualcuno.

Tuttavia, ai manifestanti non importa, “vincono a tutti i costi”, anche se infrangono la legge. Aspetta… non stanno protestando perché vogliono mantenere l’attuale statuto sull’aborto? Quindi, vogliono far rispettare la legge quando supporta la loro posizione morale (pro-aborto), altrimenti la legge non conta.

Cioè, protestare illegalmente per influenzare la decisione di un giudice.  Una rete intricata che la sinistra tesse.

Ecco quanto è sciocco il leaker.

In primo luogo, la sentenza Row v. Wade era sbagliata e politica quando i giudici precedenti votarono 7-2 nel 1973, nonostante i giudici di maggioranza fossero repubblicani di destra.  La sentenza Row v. Wade era sbagliata per una serie di ragioni, soprattutto perché è ingiusta, incostituzionale e antidemocratica per i cittadini americani. Paul Stark ha scritto un’ampia analisi sull’argomento, analizziamo le sue conclusioni.

Ingiusto: (Silver, 2017, par. 3) “I fatti dell’embriologia [ricordate quel tizio, Fauci, e seguite la “scienza”] dimostrano che l’embrione umano o il feto (l’essere la cui vita viene interrotta con l’aborto) è un organismo umano distinto e vivente nelle prime fasi dello sviluppo.”

Lo sviluppo umano inizia con la fecondazione, quando uno spermatozoo si fonde con un ovocita per formare una singola cellula, lo zigote, spiega un importante testo di embriologia. “Questa cellula altamente specializzata e totipotente segna l’inizio di ognuno di noi come individuo unico”.

La scienza afferma chiaramente che dalla fecondazione il feto è un organismo umano vivente.  Secondo la Costituzione degli Stati Uniti (e molti altri documenti internazionali) ha quindi diritto alle stesse tutele umane previste dalla legge per una persona fuori dal grembo materno.

Incostituzionale: Uno degli scopi della Costituzione degli Stati Uniti è quello di fornire un’ampia struttura legale federale, pur consentendo ai singoli Stati di legiferare in base al desiderio dei loro cittadini.

Approfondiremo la separazione dei poteri più avanti, ma questo è un principio fondamentale importante.  La sentenza Row v. Wade viola il concetto di separazione dei poteri e rappresenta una massiccia prevaricazione da parte del governo federale degli Stati Uniti.

(Silver, 2017, par. 9) “Il popolo americano adottò il Quattordicesimo Emendamento in un’epoca in cui quello stesso popolo americano promulgò numerose leggi statali con lo scopo primario di proteggere i bambini non nati dall’aborto”.

Inoltre (Silver, 2017, par. 10) “L’unica conclusione possibile da questa storia”, spiegò [il 16° Presidente della Corte Suprema] Rehnquist [in un successivo esame della Roe], “è che i redattori non intendevano che il Quattordicesimo Emendamento sottraesse agli Stati il potere di legiferare su questa materia”.

Dal momento che i Padri fondatori non intendevano limitare il potere degli Stati, perché i giudici nel 1973 si opposero a questo emendamento? La politica… era la gente istruita degli anni ’60 e ’70 e noi stavamo uscendo dalla guerra del Vietnam. Durante il COVID tutti gridavano “segui la scienza, giusto?”. Questo vale anche in questo caso.  Poiché gli scienziati hanno stabilito che il feto è una persona vivente, gli devono essere concessi tutti i diritti di protezione previsti dalla Costituzione degli Stati Uniti.  Questa sfumatura giuridica non piace alla lobby pro-aborto… li rende assassini.

Non democratico: Silver cita inoltre il giudice Byron White secondo cui

(Silver, 2017, par. 12) “[La Costituzione stessa] è ordinata e stabilita dal popolo degli Stati Uniti”, ha scritto. “Le decisioni che trovano nella Costituzione principi o valori che non possono essere letti in modo corretto in quel documento usurpano l’autorità del popolo, perché tali decisioni rappresentano scelte che il popolo non ha mai fatto e che non può sconfessare attraverso una legislazione correttiva”. La Roe ha sfidato la Costituzione e le altre leggi concordate dal popolo americano, imponendo invece la volontà di una Corte non eletta”.

Una sintesi dei tre aspetti discussi sopra è che la Roe è incostituzionale e deve essere abbattuta come STATUTO FEDERALE.  Riesco già a vedere la sinistra che si affanna sulla sedia mentre legge questo… Probabilmente è quello che sta per accadere.

Cosa succederà dopo

Durante la Rivoluzione Americana i coloni si batterono per la separazione dei poteri tra il governo federale e quello statale.  Pensavano che ogni Stato dovesse essere in grado di governare i propri cittadini secondo le proprie idee, la propria morale e la propria cultura. Questa divisione dei poteri è sancita dalla Costituzione degli Stati Uniti.

In questo caso è responsabilità del governo federale stabilire una legge (basata sulla Costituzione, sulla Dichiarazione di Indipendenza e sulla giurisprudenza) che stabilisca quando inizia la vita.  I governi statali poi approvano le loro leggi che dirigono l’attuazione di questa legge federale generale nel loro Stato. Gli Stati conservatori (Florida, Texas e South Dakota) vietano l’aborto tranne che in caso di incesto o stupro, mentre gli Stati liberali (California, New York e Illinois) facilitano l’accesso all’aborto.

Comprendendo il funzionamento della legge statunitense, come illustrato nella nostra lunga discussione precedente, è chiaro che la regolamentazione e il finanziamento dell’aborto non sono mai stati di competenza della FEDERAZIONE.  Nel parere trapelato, la SCOTUS afferma: “Perché i cittadini dovrebbero volere che un organo non eletto come la Corte Suprema legiferi sulla loro persona? Questo è il compito del legislatore che è eletto dal popolo”.

Ecco perché la Corte Suprema sta esaminando una causa intentata per estromettere il governo federale degli Stati Uniti dal settore dell’aborto.  È infatti illegale che la Corte crei leggi, si limita a giudicare o ad applicare le leggi create dal legislatore eletto. 

Ah, allora perché il Congresso non approva una legge?  Quale legge dovrebbero creare? Torniamo a seguire la scienza… Abbastanza bene per il COVID e per due anni di mascherina, abbastanza bene per questa domanda… Gli embriologi hanno detto cosa? La vita inizia dal concepimento?  Quindi, ogni aborto è un omicidio.  Legiferatelo!!! Lo statuto della Roe V Wade e qualsiasi nuova legge è quindi incostituzionale fin dal suo inizio… o in questo caso dal concepimento.

Supponendo che un qualche tipo di legge possa essere approvata, perché vorreste che uno Stato federale senza cervello regolasse ciò che potete fare con il vostro corpo? O preferireste che fosse il governo locale (leggi Stato Regionale), più vicino e meglio conosciuto da voi, ad approvare questo tipo di legge? Con questo sistema, è facile per voi cittadini avere voce in capitolo e fare scelte di vita basate sulla vostra morale. Se non vi piacciono le leggi che la Florida approva, trasferitevi a New York.  È così semplice.  Gli Stati Uniti hanno un mercato del lavoro abbondante e solido; siamo una società altamente mobile.  Ancora di più dopo il COVID, dato che la maggior parte degli impiegati lavora da casa in pigiama.

L’impatto reale

Quindi, se la Corte Suprema dovesse bocciare la Roe v. Wade, cosa cambierebbe?  Le cose possono andare in due modi: o non molto o il Congresso sarà costretto a legiferare correttamente sulla vita al momento del concepimento. Supponiamo che la prima ipotesi diventi la posizione degli Stati Uniti.

Le persone continueranno ad andare negli Stati liberali per abortire. Ma allora perché tutto questo clamore? Ahhh mio caro Direttore, $$$$$$. Attualmente gli Stati hanno la responsabilità di fornire assistenza sanitaria ai propri cittadini grazie alle tasse statali che paghiamo in quanto cittadini dello Stato.  Negli Stati Uniti paghiamo l’imposta sul reddito sia al nostro Stato che al governo federale.  C’è un certo rimborso da parte del governo federale per i programmi medici su alcune procedure, ma gli Stati finanziano la vostra assistenza sanitaria e hanno ridotto drasticamente i loro bilanci sperando in un aumento dei finanziamenti federali.

Un esempio recente: Trust for America’s Health (TFAH) ha recentemente riportato (2022, par. 7) “Nell’anno fiscale 2011-12, il finanziamento statale mediano per la sanità pubblica è stato di 27,40 dollari pro capite, con un massimo di 154,99 dollari nelle Hawaii e un minimo di 3,28 dollari in Nevada. Dall’anno fiscale 2008 all’anno fiscale 2012, la spesa statale mediana pro capite è diminuita da 33,71 a 27,40 dollari. Ciò rappresenta un taglio di oltre 1,15 miliardi di dollari, sulla base dei bilanci totali degli Stati di quegli anni, che sarebbero 1,9 miliardi di dollari aggiustati per l’inflazione”.

Voglio sottolineare che se ci si ammala a New York si va in un ospedale locale che è finanziato sia dallo Stato sia per gli interventi chirurgici elettivi pagati dall’assicurazione (federale o privata). Uno dei fatti interessanti sul sistema sanitario statunitense l’ho appreso durante la stesura della mia tesi di laurea specialistica in Leadership politica. Sorprendentemente, molti ospedali statunitensi sono finanziati principalmente da interventi chirurgici elettivi (non obbligatori).  Durante il COVID, non c’erano interventi elettivi, con una conseguente perdita di profitto per gli ospedali. Se il governo federale cessa di finanziare l’aborto a livello federale, gli Stati liberali devono fare i conti in tasca per sostenere i costi.

Caro Direttore, abbiamo discusso molto in questa lettera, quindi rivediamo le domande importanti:

  1. Che ne è di chi ha fatto la soffiata? Quale dovrebbe essere la sua pena?
  2. I manifestanti dovrebbero essere autorizzati a protestare davanti la casa di un giudice in violazione della legge?
  3.  Quindi, tutto questo baccano riguarda davvero la questione morale dell’aborto o i finanziamenti statali?

Lettere Americane 7: The US Supreme Court Employee Leaks Draft Justice’s Opinion on Landmark Row v. Wade Abortion Case.  

Dear Editor,

Right as I was finishing up my last letter to you about Cinco de Mayo in early May 2022, an illegal activity occurred in the Supreme Court of the United States (SCOTUS).  Interestingly this is not covered in any of your major Italian news outlets, which shows the unique news focus of both Europe and North America.  As of the authorship of this letter many of the final facts about the leak are still unknown but let’s review what is currently known to bring you up to speed as of 12 May 2022.

The US legal system is in a major review of a landmark case on abortion called Roe v. Wade. This case is the mainstay drumbeat of the Democratic Party and Liberals everywhere.  The fact is that Roe is a questionable case but, became law in 1973.

The Scandal

The illegal activity was an employee leak of a pre-decisional draft opinion by Justice Samuel Alito.  First, let’s address the leak. Employees of the Supreme court are trusted with some of the most important legal materials in the United States.  They are sworn to protect the information they are entrusted with, especially draft opinions that have not yet been circulated or discussed by the other Justices.  Draft opinions are circulated, then discussed, followed by a vote.  SCOTUS justices then write their opinions, which become public record and the decision is released. This process has been scuttled by the leak.  There are about 37 clerks and 30 staff, or a Justice could be involved. As they are all attorneys the penalty could be fired, sanctioned, and disbarred as an attorney (all highly likely).  In the event it was a Justice who leaked, they will likely be impeached by the House and confirmed by the Senate therefore losing their lifetime appointment.

The leak occurred because someone disagreed with Justice Alito’s (who is the second Italian-American SCOTUS Justice in the history of the court) draft opinion on Roe and attempted to cause SCOTUS to change their draft opinions.

As a result of the leak, far left protestors have surrounded the Supreme Court and private homes of the Justices, many of whom have small children.  The intent of the protest is to influence and change the opinion of the Justice, which is against US law.  Cornell’s Law School’s website specifically discusses 18 U.S. Code § 1507 – Picketing or parading

“Whoever, with the intent of interfering with, obstructing, or impeding the administration of justice, or with the intent of influencing any judge, juror, witness, or court officer, in the discharge of his duty, pickets or parades in or near a building housing a court of the United States, or in or near a building or residence occupied or used by such judge, juror, witness, or court officer, or with such intent uses any sound-truck or similar device or resorts to any other demonstration in or near any such building or residence, shall be fined under this title or imprisoned not more than one year, or both. 

Nothing in this section shall interfere with or prevent the exercise by any court of the United States of its power to punish for contempt.”

Now I can understand the protests at the Supreme Court even though it is against the law. But, clearly protesting at someone’s home is against the law, and is morally reprehensible to threaten someone’s family.

However, the protestors don’t care, “win at all costs,” even if they break the law. Wait…aren’t they protesting because they want to keep the current abortion statute? So, they want to enforce the law when it supports their moral position (pro-abortion), otherwise the law doesn’t countI.E., illegally protesting to influence a Justice’s decision.  A tangled web the left weaves.

Now here is how silly the leaker is. First, the Row v. Wade was faulty and political when previous justices voted 7-2 in 1973, despite the majority Justices being right leaning Republicans.  The Row v. Wade statue was faulty for a variety of reasons mostly because it is Unjust, Unconstitutional, and Undemocratic for the American Citizenry.  Paul Stark wrote an extended analysis on the subject, let’s explore his conclusions.

Unjust:

(Silver, 2017, Para. 3) “The facts of embryology [remember that guy Fauci and follow the “science”] show that the human embryo or fetus (the being whose life is ended in abortion) is a distinct and living human organism at the earliest stages of development. “Human development begins at fertilization when a sperm fuses with an oocyte to form a single cell, a zygote,” explains a leading embryology textbook. “This highly specialized, totipotent cell marks the beginning of each of us as a unique individual.”

Clearly science states from fertilization a fetus is a living human organism.  According to US Constitution law (and many other international documents,) is therefore entitled to the same human protections under the law a person outside the womb is.

Unconstitutional:  One of the purposes of the US Constitution is to provide a broad overarching federal legal structure yet allow individual states to legislate based on the desire of their state citizens.  We will go into separation of powers below but, this is an important fundamental principle.  Row v. Wade violates the concept of separation of powers and is a massive overreach on the part of the US Federal Government.

(Silver, 2017, Para. 9)  “The American people adopted the Fourteenth Amendment during an era in which those same American people enacted numerous state laws with the primary purpose of protecting unborn children from abortion.”

Furthermore

(Silver, 2017, Para. 10)  “The only conclusion possible from this history,” [16th Supreme Court Chief Justice] Rehnquist explained [in a subsequent examination of Roe], “is that the drafters did not intend to have the Fourteenth Amendment withdraw from the States the power to legislate with respect to this matter.”   Since the Founding Fathers did not intend to limit the power of the States, why did the Justices in 1973 argue against this amendment? Politics…was 60s and 70s educated people and we were exiting the Vietnam War.

During COVID everyone shouted, ‘follow the science, right?’ That applies here too.  As scientists have established that the fetus is a living person, they must be afforded all rights to protection under the US Constitution.  That legal nuance doesn’t sit well with the Pro-Abortion lobby…Makes them murderers.

Undemocratic:  Silver further quotes Justice Byron White that (Silver, 2017, Para 12)

“[T]he Constitution itself is ordained and established by the people of the United States,” he wrote. “[D]ecisions that find in the Constitution principles or values that cannot fairly be read into that document usurp the people’s authority, for such decisions represent choices that the people have never made, and that they cannot disavow through corrective legislation.” Roe defied the Constitution and other laws that the American people agreed upon—and imposed the will of the unelected Court instead.”

A synopsis of the three facets discussed above is that Roe is unconstitutional and must be struck down as a FEDERAL STATUTE.  I can just see the left clawing their nails into the chair as they read this…  Likely that is what is coming.

What will happen next

During the American Revolution Colonists fought for a separation of powers between the Federal and State governments.  They mused that each state should be able to govern its citizens according to their ideas, morals, and culture.  This division of powers is enshrined in the US Constitution.  In this case it is the Federal Government’s responsibly to set a statute (based on the Constitution, Declaration of Independence, and case law) that states when life begins.  The State Governments then pass their own laws that direct implementation of that overarching federal law in their state. Conservative states (Florida, Texas, and South Dakota) will ban abortion except in case of incest or rape, liberal states (California, New York, and Illinois) will facilitate abortion access.

Understanding how US Law functions as outlined in our lengthy discussion above, clearly the regulation and funding of abortion WAS NEVER FEDERAL BUSINESS.  SCOTUS states in the leaked opinion, “why would citizens want an UNELECTED BODY like the Supreme Court to make law on the citizens person? This is the job of the legislature who are elected by the people.”   Hence, why the Supreme Court is examining a lawsuit brought before it, to extract the US Federal Government from the abortion business.  It is in fact, unlawful for the court to MAKE law, they only adjudicate or enforce laws created by the elected legislature.  Ah so why doesn’t the Congress pass a law then??? They don’t want the heat, to they try to push it to someone else to create the law… What law should they create? Back to follow the science… Good enough for COVID and two years of mask wearing, good enough for this question…Embryologists said what? Life begins at conception?  Therefore, any abortion is murder.  Legislate that!!! Roe V Wade statute plus any new law is therefore unconstitutional from its inception… or in this case CONCEPTION.

Assuming some type of law is passable, why would you want a mindless Federal State regulating what you can do with your body? Or would you prefer the local (read State) government who is closest and better known by you, to pass this type of law? Using this system, it is easy for you the citizen to have a voice and make life choices based on your morals. Don’t like what laws Florida passes, move to New York.  It is that simple.  US has a plentiful and robust job market; we are a highly mobile society.  Even more so post COVID, as most office workers now function from home in their Pajamas.

The Real Impact

So, if the Supreme Court, strikes down Roe v. Wade, what is going to change?  This can go two ways either not much or congress will be forced to properly legislate life at conception.

Let’s assume the former becomes the US position. People will still go to liberal states for abortions. But why then all the fuss? Ahhh my dear Editor… $$$$$$. States are currently responsible to provide health care to its citizens from States Taxes we pay as State Citizens.  We in the US pay income tax to both our State and Federal government.  There is some reimbursement from the Federal Government for medical programs on certain procedures but, the States fund your healthcare and they have shrunk their budgets dramatically hoping for increased federal funding.  A recent example: Trust for America’s Health (TFAH) recently reported (2022, Para. 7)

“In FY 2011-12, the median state funding for public health was $27.40 per capita, ranging from a high of $154.99 in Hawaii to a low of $3.28 in Nevada. From FY 2008 to FY 2012, the median per capita state spending decreased from $33.71 to $27.40. This represents a cut of more than $1.15 billion, based on the total states’ budgets from those years, which would be $1.9 billion adjusted for inflation.”

I want to emphasize, that if you get sick in New York you go to a local hospital that is funded both by the state and elective surgeries paid for by insurance (federal or private). One of the interesting facts on US healthcare system, I learned while writing my master’s thesis on Policy Leadership. Surprisingly, many of the U.S. hospitals are primarily funded by elective (not mandatory) surgeries.  During COVID, there were no elective surgeries, thus massive profit loss for hospitals. If the Federal government ceases to fund abortion at the Federal level, Liberal States must come out of pocket to support those costs.

My Dear Editor we have discussed a lot in this letter so, let’s review the important questions:

  1. What about the leaker? What should their penalty be?
  2. Should protestors be allowed outside a Justice’s home in violation of the law?
  3. So, is all the rabble rousing really the moral issue of abortion or about state funding?
